Terms of Service

1. Booking Confirmation: A photoshoot booking is only confirmed once a non-refundable retainer deposit (as specified during checkout) has been paid and these Terms have been accepted.

2. Remaining Balance: The remaining balance of your photoshoot package must be paid on or before the date of the scheduled session. We reserve the right to withhold digital gallery delivery and physical print production until full payment has cleared.

3. Payment Processors & Bank Statement Descriptors:

   1. Stripe (Credit / Debit Cards): Online card payments, booking deposits, and automated card vaults are securely processed via Stripe. On your bank or credit card statement, these charges will typically appear under the trading name Sploot & Co. (or SPLOOTUK).

   2. PayPal: Payments processed via PayPal are remitted directly to our parent company profile, Peter Constable Media Ltd. Your PayPal receipt and account statement will show Peter Constable Media Ltd as the merchant of record.

1. Client Rescheduling: If you need to reschedule your session, you must give us at least 48 hours' written notice. Your deposit will be transferred to a mutually agreed new date within 60 days. Cancellations made with less than 48 hours' notice may forfeit the booking deposit.

2. Weather Conditions (Outdoor Shoots): Outdoor pet photography is subject to UK weather. If extreme weather (e.g., heavy rain, high winds, or severe heatwaves dangerous to animals) prevents the shoot from occurring, Sploot & Co. will reschedule the session at no additional charge.

3. Illness or Animal Emergency: If your pet or a key family member becomes unwell, please inform us as soon as possible. We prioritize animal welfare and will accommodate rescheduling without penalty.

1. Vaccinations & Health: You confirm that your pet is in good general health and up-to-date with essential vaccinations or titers prior to attending a session.

2. Behavior & Control: You remain fully responsible for your pet’s behavior and safety at all times during the shoot. Pets must be kept on a lead in public or non-enclosed spaces unless agreed otherwise in advance.

3. Liability: Peter Constable Media Ltd accepts no liability for injury, loss, or damage caused by your pet to third parties, venues, or studio property during a session. Any damage to studio equipment caused by uncontrolled animal behavior may incur replacement costs.

• Intellectual Property: Under the UK Copyright, Designs and Patents Act 1988, all copyright, ownership, and intellectual property rights in all photographs created by Sploot & Co. remain permanently with Peter Constable Media Ltd.

• Personal Usage License: Upon full payment, clients are granted a non-exclusive, perpetual personal use license for their delivered digital files. You may print, share on personal social media, and display the images for non-commercial purposes.

• Prohibited Uses: You may not edit, crop out watermarks on promotional previews, re-sell, license, or submit photographs to commercial third parties, competitions, or stock agency platforms without express written permission from Peter Constable Media Ltd.

• Model Release & Portfolio Use: As outlined in our client booking form, Sploot & Co. retains the right to display gallery samples, social media reels, website portfolio images, and promotional materials featuring session photographs, unless a private non-disclosure shoot arrangement was formally agreed in writing prior to the session.

1. 20% Revenue Pledge: Sploot & Co. pledges 20% of every photoshoot booking fee to our Sploot Rescue Fund.

2. Fund Application: Funds are used exclusively to purchase enrichment toys, treats, and care packs for shelter animals during photography visits, or to issue direct financial grants to UK-registered animal charities.

3. Legal Status: Sploot & Co. and Peter Constable Media Ltd are commercial business entities and do not operate as a registered charity. Direct customer tips or Ko-fi contributions received for the fund are accounted for as matched project expenses to maintain full transparency and tax compliance.

1. Editing & Style: Photography style, color grading, and creative retouching remain at the artistic discretion of Sploot & Co.

2. Gallery Turnaround: Online proofing galleries are typically delivered within 14–21 days of the photoshoot date.

3. Physical Goods & Custom Prints: Because bespoke wall art, albums, and fine art prints are custom-manufactured upon client selection, print orders cannot be canceled or refunded once submitted to our printing lab, except in cases of manufacturing defects or shipping damage.

Item descriptionTo the maximum extent permitted by UK law:

1. In the unlikely event of total photographic failure, equipment malfunction, or digital media corruption beyond our control, Peter Constable Media Ltd’s liability is strictly limited to a full refund of all monies paid for the session or a complimentary re-shoot.

2. Peter Constable Media Ltd shall not be liable for any indirect, consequential, or incidental loss arising out of or related to our services.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
